This is true that there was a treaty of accession between The Federal State of Jammu and Kashmir and the Dominion of India on 26 October 1947 enabling the government of India to complained to the United Nation Security Council of interference into internal affairs of a sovereign state. 
The UNSC recognized the treaty in its Resolution 47 (1948) and UNCIP Resolution of 13 August 1948 and 5th January 1949.
The Government of India under the subject treaty was legally bound to ensure the unity and territorial integrity of the state of Jammu and Kashmir and allow the people of the state to decide their future through democratic means and methods without any fear or intimidation. 
The government of India not only failed to fulfill its responsibilities under the treaty of accession but instead it had become a colonial force to rule the subject state against the wishes of its people.
The government of India went on to dismiss the elected Prime Minister of Jammu and Kashmir in 1953 so to imposed its own puppet government.
The duty of the government of India under the subject treaty, even after the signing of the Simla Agreement on 2 July 1972 between India and Pakistan, where the state of Jammu and Kashmir and its people was not the party, is, that India must ensure the reunification of Jammu and Kashmir as it was before 14 August 1947 enabling its people to decide their future through democratic means by electing their representatives who could formulate the future constitution to be put before people for the final vote and this is also the requirement of the UNSC and UNCIP resolutions. 
The State of Jammu and Kashmir belongs to its people, but, we don't deny the fact that India, Pakistan, and China are Jammu and Kashmir's next-door neighbors, yet the people of Jammu and Kashmir waiting for their right to exercise their right to self-determination. 
Kashmir International Front (KIF) reject the rigid position of both India and Pakistan and demand that both countries need to put in place the arrangement which would enable the people of Jammu and Kashmir from both divides to elect their representatives in an election held under the UN supervision for the United Jammu and Kashmir Parliament. The subject elected representatives would be able to prepare the future constitution of the State of Jammu and Kashmir from Aksi Chin to Mangla and from Lakhanpure to Hunza, and, to settle relations with China, India, and Pakistan under the principle of sharing sovereignty, that would be beneficial for all parties. The subject draft constitution could then be put before the people of Jammu and Kashmir for a final vote. 
This is the easy way out to solve the issue which would satisfy its people, China, India, and Pakistan to look forward in terms of cooperation in order to eradicate poverty and to establish a better environment for the regional and international peace rather than to be a prisoner of historical prejudices and bigotry and to keep indulging the politics of hate, conflict, and confrontation. 
People of Jammu and Kashmir from both divides would never accept the division of their motherland or any further bifurcation by using the rigged election on either side of the divide so as to dilute the aspirations of the people of Jammu and Kashmir.
