I think Pakistan had never
abolished capital punishment; therefore the term "restoring" looks strange.
I am also against capital punishment but it need proper debate in every society
on its merit and demerit. In your justice system, if there is capital punishment,
so it must be carried out, but, fair justice is fundamental. The fact that on
one-hand, killing people by manipulating
law and justice system (ZAB), while on other-hand, protecting hard core
criminals (Omar Sheikh etc.) in Pakistan, is a case in point.
Terrorism is mystery in Pakistan. Those observe closely the terror activities
in Pakistan would agree that law enforcement and security establishment itself seen
to be sympathizers with terrorists cause; hanging few hundred offenders might help,
but, it would not eliminate terrorism.
It is Government's job to tell the whole story to the public; the data of terrorists
who carried out the act of terror; their helpers; source of funding; source of
arms; source of training.
My own observation shows that Pakistani authority for one reason or another
trying to cover-up terrorists data and don't disclose the full story to the
public. May be they have been and still are, the tools to influence political
objectives within Pakistan by attacking secular parties and protecting
conservative parties; attacking pro-democracy theologians and religious leaders
and protecting anti-democracy theologians and religious leaders. It shows that
Pakistani Establishment do have some kind of common agenda with Saudi Arabia
which is reflecting in policy formulation within Pakistani politics yet unknown
to its people.
Purely on merit and demerit, it’s proved through empirical evidence that
neither torturing suspect is the proper source to obtain correct information or
implementing capital punishment is deterring to offenders. Europe doesn’t carry
out capital punishment where US do. Crime rate in Europe is less than US.
Pakistan, Afghanistan and India might have special circumstances and for short
term it might create an impact, but not for long term.
In addition, when law enforcement and security establishment use criminals from
four walls of the prison to use them to carry out more crimes outside prison
and prisons were used just to protect them. If it is the case, then no law would work. It is call
lawlessness.
